New US
Law To Establish a Voluntary Private Sector Emergency
Preparedness Certification Program |
|
Legislation was enacted on August 3, 2007 which affects
all private sector businesses, officially titled
"H.R.1:Implementing Recommendations of the 9/11 Commission Act
of 2007". This law has wide ranging provisions which are
targeted at improving the nation's preparedness and security.
Title IX of the law requires the Department of Homeland
Security (DHS) to ensure the implementation of a voluntary
program to certify organizations are prepared for emergencies.
The program targets improving private sector preparedness and
will be administered by a non-government organization. DHS has
only 210 days to begin the implementation of this program so
it is probable we will see early certification program
activities this year.
While this program is voluntary,
it is likely that being certified as prepared could have a
variety of positive regulatory, market, customer and insurance
implications. Preparedness is increasingly recognized as
simply a good business practice and this new preparedness
program is just one more good reason for organizations to
review their business continuity programs and consider
strengthening their overall preparedness for business
disruptions and disasters.
FTC's business continuity
staff is monitoring DHS progress on implementing this new law
to be sure our customers get an early understanding of the
preparedness standard and the implications of the voluntary
certification. We can assist your organization with a review
of your business continuity program and suggest a variety of
low-cost solutions (
www.ftccontinuityservices.com) to help you be more
prepared and be ready for getting certified should you choose
to take advantage of this new program.
